Kaiser PLLC Files Amicus Briefs on Behalf of Professor Peter Conti-Brown in Support of Federal Agency Independence Before D.C. Circuit
On April 9, 2025, Kaiser PLLC filed amicus briefs in two significant cases pending before the U.S. Court of Appeals for the D.C. Circuit—Harris v. Bessent (Nos. 25-5037, 25-5055) and Wilcox v. Trump (No. 25-5057)—each raising critical constitutional questions about the independence of federal agencies.
Both briefs were filed on behalf of Professor Peter Conti-Brown, a leading financial historian and legal scholar, who offers an expert perspective on how overturning Humphrey’s Executor would undermine the independence of the Federal Reserve and imperil the carefully balanced structure Congress designed in 1935.
The briefs argue that the Federal Reserve’s monetary policy functions are deeply and inseparably linked to its regulatory and supervisory roles and that undermining its independence would devastate U.S. capital markets and the global strength of the dollar.
